An information was lodged by Stipendiary Steward Mr C J Allison under Rule 869 (3) (b) alleging that with approximately 350 metres to run Mr R M Tither driving MEGLEA, shifted inwards when not sufficiently clear of FRANCO AMITY, checking that runner, and CRUZHEDOZ, FORRESTERS and HOT SHOT BABE.
--Mr Tither admitted the breach.
--Mr Allison and Mr Tither agreed that all evidence given in the protest hearing could be taken into account in this hearing.
--In fixing penalty, Mr Tither had incurred a fine under this rule 6 May 2007, and a suspension on 18 November 2007. Credit was given to his guilty plea.
--Mr Tither was suspended up to and including the conclusion of racing on Tuesday 8th April 2008, effectively three driving days.
