--Mr M Williamson assistant stipendiary steward demonstrated the incident on the video of the gesture with the whip 3-4 strides prior to the finishing post. Mr Coles made submissions on penalty in that Mr Leveque had not previously been penalised under this rule and that $300 was appropriate under this rule. Mr Leveque when asked had no submission to make with respect to penalty
--The panel took these submissions into consideration including admission of the breach and that this was the the first breach of this rule.A penalty of $300 was imposed.
