This is an information filed by Stipendiary Steward Mr. T. TAUMANU against Mr. D. BUTCHER driver of MIAMI H alleging a breach of the above rule in that he drove his horse carelessly causing interference to ZUTANO driven by Mr. J. STORMONT with about 450 metres to run.

This is an information filed by Stipendiary Steward Mr. T. TAUMANU against Mr. D. BUTCHER driver of MIAMI H alleging a breach of the above rule in that he drove his horse carelessly causing interference to ZUTANO driven by Mr. J. STORMONT with about 450 metres to run.  Mr. BUTCHER denies the breach and is present at the hearing.

Mr. TAUMANU showed the film of the incident.  He said Mr. BUTCHER came inwards too quickly and caused interference to ZUTANO which broke and lost several lengths.  He said Mr. BUTCHER had clicked up his horse just at the time of the incident instead of pulling his horse outwards.  He agreed with Mr. BUTCHER that Mr. BUTCHER and Mr. STORMONT were going for the same spot.  He said Mr. BUTCHER could have given Mr. STORMONT more room.

Stipendiary Steward Mr. J. MUIRHEAD said the drivers had gone for the same gap, Mr. STORMONT had stayed there and Mr. BUTCHER stayed tight.  He suggested Mr. BUTCHER could have driven in a manner not to get too close.  He conceded to Mr. BUTCHER that Mr. STORMONT had insufficient room to move outwards when he did.

Mr. BUTCHER said he and Mr. STORMONT had gone for the same position but there was insufficient room for Mr. STORMONT to be there.  He said he gave his horse a tiny flick with the whip and it ducked in – the horse was a three year old having its first start.  He said he always had an advantage over Mr. STORMONT.  He said he took a position he believed he was entitled to and held his ground.

Mr. TAUMANU conceded that when a horse is flicked with the whip and ducks in, it would catch every driver.

Mr. TAUMANU and Mr. BUTCHER summed up in accordance with their evidence, Mr. BUTCHER saying that Mr. STORMONT should not have been where he was.  He repeated that he had held his line and had been given no reason why he should have given Mr. STORMONT more room.  Mr. STORMONT was not called to give evidence.

DECISION AND REASONS

At about the 450 metre mark Mr. STORMONT moved his horse outwards and at the same time Mr. BUTCHER moved his horse inwards.  However MIAMI H was ahead of ZUTANO.  Both drivers then held their line, racing in tight quarters for about 40 metres.  Mr. BUTCHER flicked his horse with the whip and it ducked inwards causing interference to ZUTANO.  At that stage MIAMI H had a clear advantage over ZUTANO.  Mr. BUTCHER took immediate corrective action.  The informants case was that Mr. BUTCHER had moved in too quickly and / or had got too close to ZUTANO.  Mr. TAUMANU in effect conceded the inward movement of MIAMI H was beyond the control of Mr. BUTCHER.  Mr. MUIRHEAD in effect Mr. STORMONT should not have been where he was.   The horses were racing tightly but there was no problem until MIAMI H ducked inwards.  The evidence does not establish any carelessness on the part of Mr. BUTCHER.  The information is dismissed.
