An information instigating a protest lodged by Stipendiary Steward Mr T Taumanu on behalf of the horse AROSE driven by Mr R Brosnan and placed 10th by the Judge against the horse MARIA?S REIGN driven by Mr R Hollis and placed 4th by the Judge on the grounds of interference with about 180m to run. Mr Hollis represented the connections of MARIA?S REIGN. He said he wanted to contest the protest. Mr Muirhead Stipendiary Steward showed the video film of the incident. He said MARIA?S REIGN moved out from the running line and as a consequence the front leg of AROSE hit the sulky wheel of QUEEN OF MY HEART causing AROSE to break and lose its chance. Mr Hollis said that AROSE was always behind MARIA?S REIGN or at best level with it and that they both went for the same gap. He said he was not sure where contact was made. After further viewing of the film Mr Taumanu conceded that he could not be sure that the outward movement of MARIA?S REIGN caused AROSE to make contact with the sulky wheel of QUEEN OF MY HEART. Unfortunately by the time the hearing commenced, Mr Brosnan had left the course and was not available to give evidence. I was left in a considerable state of doubt as to exactly why the contact had been made. I could not detect any outward movement of AROSE when I viewed the film. Given all of those circumstances I dismissed the protest.
