Mr Laking you have admitted a breach of rule 858(3), in that being the rider of HEPBURN in race 8 you weighed in .75 of a kilo in excess of your weigh out weight. We thus find the charge proved.
----You have no explanation other that the fact you had a sip of a drink, about 1/2 a cup you estimate, and that the horse had sweated up a little. You had a warning after race 3 when you also weighed in over-weight for 2nd on GRACIE PARK.
----The breach of this rule disadvantages both the betting public and the connections of the horse, in that the horse is carrying a greater weight than that which it is carded to carry. You clearly have on-going weight problems but this is your first breach of this particular rule. Mr Ching has said the matter can be dealt with by way of a fine and we agree. Nonetheless, you must address further these issues you have with your weight. We remind you of your obligations under the Rules of Racing and fine you the sum of $250.
