Decision: Following the running of race number 5 an information was lodged by Stipendiary Stewards instigating a protest in respect of Raindowne (12) placed first by the Judge alleging that it forced Lislea’s Flame (13), placed 2nd by the Judge, wider on the track with approximately 1500 metres to run.

Following the running of race number 5 an information was lodged by Stipendiary Stewards instigating a protest in respect of Raindowne (12) placed first by the Judge alleging that it forced Lislea’s Flame (13), placed 2nd by the Judge, wider on the track with approximately 1500 metres to run.  At the outset of the hearing Mr Adlam, the trainer of Raindowne confirmed to the Committee that he represented the connections of the horse and that the protest was contested.

Mr Ydgren, for the Stipendiary Stewards, said that Lislea’s Flame (Ms D Ottley) was moving three wide round the field when Raindowne (Mr Dunn) moved out and Lislea’s Flame was forced to race wider on the track.

Ms Ottley (Lislea’s Flame) said that she had made a forward move with her horse round the outside of the field. Raindowne had moved out and that she didn’t take a hold of her horse as it was inexperienced and she was unsure as to what would happen.  Ms Ottley could not give any assistance as to whether or not the nose of her horse was alongside or forward of the wheel of Raindowne.

Mr McIntyre, Stipendiary Steward, said that when Lislea’s Flame moved forward Raindowne had moved out. The video evidence of the appropriate part of the race was shown to the Committee by Mr McIntyre but given the angles of the cameras that evidence was of little assistance.

Mr Dunn (Raindowne) said that he was aware of Ms Ottley moving forward and he came out and was in the wider running line before Ms Ottley’s horse’s nose was alongside or forward of his outside wheel. He said that Ms Ottley’s horse over reacted when he came out. Mr Adlam said that  the movement out was legitimate and that Raindowne was already out when Lislea’s Flame  raced up and alongside it.

The Committee after giving consideration to the evidence of all parties is of the view that it has not been established that there was a breach of the rule. In that regard Mr Dunn and Mr Adlam were certain in their evidence while Ms Ottley was uncertain as to whether she was now forced wider by Raindowne and, as stated previously, the video evidence did not assist the Committee in establishing whether or not there was a breach of the rule. Accordingly, the protest is dismissed.
