Following the running of Race 7, the Clark Boyce Lawyers Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott under Rule 869 (6)(b) and (c) alleging a breach of the push out rule by Mr L. K. James

DECISION AND REASONS:

Following the running of Race 7, the Clark Boyce Lawyers Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott under Rule 869 (6)(b) and (c) alleging a breach of the push out rule by Mr L. K. James, the driver of "Rarity Franco", with a little over 1000 metres to run.

Mr James confirmed at the hearing that he admitted this breach of the Rules, and he also agreed that he understood the charge and the Rule.

Video coverage of the incident was shown to illustrate that Mr James had moved "H Adour" four wide just prior t the 1000 metre mark.

PENALTY: Mr Escott advised that Mr James had no previous relevant convictions and taking this and his guilty plea into account a fine of $200-00 was recommended.

Mr James was asked if he preferred a fine to a suspension, and he said he would prefer a suspension. Mr Escott recommended a four day suspension. It was established that Mr James had two drives at Invercargill this Sunday 26 August 2007, and that any suspension would start after this date. Mr James also advised that he had no confirmed drives in the near future, although there was always a chance he could obtain drives at upcoming meetings.

Taking all the above matters into account I was satisfied that a four day suspension was appropriate. The suspension is to commence after the completion of racing on 26 August 2007 and is to end after the completion of racing on 9 September 2007.
