--This is an information filed by Stipendiary Steward Mr. J. MUIRHEAD against Mr. J. ABERNETHY driver of BRAEMOOR alleging a breach of the above rule in that his horse struck the sulky wheel of PISTOL PACKING MAMA driven by Mr. D BUTCHER with about 1050 metres to run resulting in the tyre coming adrift with 150 metres to run, Mr. ABERNETHY then improving his horse inside PISTOL PACKING MAMA resulting in BRAEMOOR becoming entangled with the loose tyre causing interference to both horses and both horses being pulled up.

--This is an information filed by Stipendiary Steward Mr. J. MUIRHEAD against Mr. J. ABERNETHY driver of BRAEMOOR alleging a breach of the above rule in that his horse struck the sulky wheel of PISTOL PACKING MAMA driven by Mr. D BUTCHER with about 1050 metres to run resulting in the tyre coming adrift with 150 metres to run, Mr. ABERNETHY then improving his horse inside PISTOL PACKING MAMA resulting in BRAEMOOR becoming entangled with the loose tyre causing interference to both horses and both horses being pulled up.
--Mr. ABERNETHY admitted the breach and was present at the hearing.
--Mr. MUIRHEAD showed and interpreted the film of the last 1100 metres of the race. At about the 1050 metres, PISTOL PACKING MAMA was leading and BRAEMOOR was in the trail. A front leg of BRAEMOOR struck the inner sulky wheel of PISTOL PACKING MAMA. At the 800 metres the tyre and tube on the inner wheel could be seen to have come adrift, caught around the axle and dragging on the track. At about the 150 metre mark, PISTOL PACKING MAMA was still leading and BRAEMOOR was still trailing. PISTOL PACKING MAMA moved slightly outwards and Mr. ABERNETHY attempted to improve BRAEMOOR on the inside where there was insufficient room. The near front leg of BRAEMOOR became entangled in the loose tyre and both horses were pulled up.
--Mr. ABERNETHY said it was BRAEMOOR’s first start without earplugs and the horse had raced keenly from the start. He said PISTOL PACKING MAMA had run outwards prior to the sulky wheel being struck and he could not hold BRAEMOOR. He said BRAEMOOR got keener and keener in the straight, saw a half gap, grabbed the bit and then stood on the tube.
--In response Mr. MUIRHEAD said Mr. ABERNETHY should have followed PISTOL PACKING MAMA outwards at the 1050 metre mark. He conceded BRAEMOOR had shown a tendency to lug out during the race.
--Mr. ABERNETHY acknowledged that he was aware that the tyre and tube had come adrift.
--PENALTY
--Mr. MUIRHEAD said the recommended starting point was a fine of $400 and/or a two week suspension. He said Mr. ABERNETHY had one breach of the rules in the last twelve months which might be relevant. He pointed to the consequential effects in that both horses were pulled up. He recommended a fine of $500 or a two day suspension.
--Mr. ABERNETHY said BRAEMOOR had been overracing and he had tried his best to hold on to it. He preferred a fine to a suspension. In fixing penalty the committee takes into account the guilty plea. The recommended starting point, the submissions of Mr. MUIRHEAD and Mr. ABERNETHY and accepts that he has a clear driving record.
--The committee views the offending as being mid-range on the scale of seriousness taking into account the mitigating effects of BRAEMOOR’s racing manners. The committee accepts Mr. ABERNETHY steered BRAEMOOR inwards in the straight when he should not have. However the committee also believes there was overall an element of misfortune. Balancing those matters but with emphasis on the mitigating factors a fine of $400 is imposed.
