--Following the running of Race 5 the trainer of the provisionally placed 2nd horse, Gorse, protested against the provisional winner, Morepork, alleging interference in the home straight.

--Rule 876 (1) reads – If a placed horse or its rider causes interference within the meaning of this Rule 642 to another placed horse and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred they may place the first mentioned horse immediately after the horse intereferd with.
--Films of the incident were shown and Mr D Haworth pointed out the alleged incident where Gorse he believed was interfered with when Morepork moved inward. He believed his horse was knocked sideways and had to change stride before being able to be fully ridden out in the run to the line. He felt the incident cost him from winning as his horse travelling well at the point of the incident. The bump, he believed, was nasty and his horse recovered and made up ground.
--Mr Breslin, the trainer of Morepork, told the committee his horse was travelling well and yes it did move inwards and make contact with Gorse, but he believed jockey Myers corrected immediately and was always going to win.
--Jockey L Innes informed the committee he was about ½ a length behind Miss Myers mount Morepork, when it moved inward and bumped. He was put off stride, recovered and was finishing well at the line.
--Miss Myers told the committee her mount was travelling the inward movement did result in her bumping Gorse. She immediately righted her mount and travelled well to the line.
--Both trainers in summing up reiterated their relevant impressions of the incident, with no new evidence being presented.
--Stipendiary Steward Goodwin, under the rules of racing was asked to comment. He told the committee that Morepork was travelling well, it did move inwards and bump Gorse, was immediately corrected and stretched out well to the line. He believed it was doubtful that without the bump Gorse was travelling well enough to win. He felt Morepork was travelling too well.
--Decision and Reason:
We have revisited Rule 642 (1) and believe the wording of “is of the opinion that the horse interfered with would have finished ahead of the first mentioned horse” is implicit. The films are clear Morepork did move inwards and bump Gorse. We did note that Gorse was about ½ a length behind when the bump occurred. Ms Myers did we believe correct immediately and continue her run to the line.
While Gorse was unbalanced for a stride or two we are of the opinion that it was doubtful whether or not it would have finished ahead of Morepork. While some ground on Morepork was made up the official margin between first and second was ¾ of a length
--The protest was dismissed and placings allowed to stand.
