Following Race 3 a protest was lodged by Mr AR Coles pursuant to Rule 876(1).

Following Race 3 a protest was lodged by Mr AR Coles pursuant to Rule 876(1). It was alleged that DARLEY BALL PARK (No.8) ridden by apprentice jockey T Harris placed second by the judge interfered with the chances of SNIPPETS INIT (No.10) placed third by the judge. The interference was alleged to have occurred in the final straight.

The official margin between second and third placing was half a length.

We heard evidence from Mr Oatham who demonstrated on race videos head-on and back-on. He indicated that DARLEY BALL PARK moved out two horse widths causing severe interference to SNIPPETS INIT, that horse thereby losing momentum at an important stage of the race. Mr D Lang, representing the trainer, M Mateara, conceded that there was noticeable interference caused by DARLEY BALL PARK, but it was close to the finishing line.

Mr T Russell, rider of SNIPPETS INIT said that as a result of the interference it cost him at least half a length.

DECISION:

The Committee carefully considered all evidence and viewed the race video films (head-on and back-on). The film clearly shows DARLEY BALL PARK moving out into the line of SNIPPETS INIT and causing severe interference.

We find that there was interference and the chances of SNIPPETS INIT were affected in gaining a better placing. Accordingly, we have a discretion to relegate and we do so because there was significant interference suffered by SNIPPETS INIT caused by DARLEY BALL PARK at a critical stage of the race. Also taking into account the margin of half a length between second and third placing, also that SNIPPETS INIT finished strongly to the line. Accordingly, the protest is upheld.
