Following the running of Race 10, the Trusts Charitable Foundation Trot, an information was lodged by Stipendiary Steward Mr N R Escott, under Rule 869 (2) (a) against Mr C Markham, the driver of SEA SPRAY DARLING in that Mr Markham used his whip excessively over the concluding stages of the race. Mr Markham admitted the breach of the rule and did not wish to be present.
--Video footage showing the actions of Mr Markham's usage of the whip indicated that he struck his horse 5 times, at about the 200 metre mark and, after a short let up, struck his horse continuously in the order of 16 times from the 150 metre to the 50 metre mark at which stage Mr Markham let up on his whip action.
--In assessing penalty, Mr Escott requested that consideration be given to Mr Markham's guilty plea and that a fine of $200.00 be imposed.
--Given Mr Markham's clear record under this rule, as well as his guilty plea, a fine of $200 is imposed.
