In Race 4, the ?Fruit World 1200?, Stipendiary Steward Mr A Coles, filed an information alleging a breach of Rule 871(1)(d) by apprentice jockey Troy Harris

In Race 4, the ?Fruit World 1200?, Stipendiary Steward Mr A Coles, filed an information alleging a breach of Rule 871(1)(d) by apprentice jockey Troy Harris in that he shifted inwards after the start when not sufficiently clear dictating PIN A FOUR, ridden by L Allpress inwards on to OUR WORLD ridden by L Tiley, who was severely tightened along with several other runners.

Mr Coles presented rider L.Allpress and L.Tiley who gave evidence that outward pressure 100 metres after the start caused severe tightening to their horses and others on their inside caused by the inward movement of T.Harris on TEE GEE when he was only one length clear of L.Allpress on PIN A FOUR. Although both riders called for relief, it did not occur, and the severe checks occurred.

Mr Treweek demonstrated the incident on the head-on and side-on video and stated that T.Harris was not the sufficient two lengths clear when he moved across the inside horses dictating their lines.

Mr McKeon, representing apprentice T.Harris, stated that there was no contact between T.Harris and L.Allpress and that he moved across as she rolled away.

The committee did not accept this argument as pressure was from the outside caused by T.Harris on TEE GEE even though no contact was made. The committee were satisfied that he moved across when not sufficiently clear and found the breach of the rule established.

Submissions as to penalty were received from Mr Coles who said the interference was severe and from Mr McKeon and T Harris who had not admitted the breach of the rule.

The committee took into consideration the good riding record of T Harris but noted the severity of the incident. Apprentice T Harris was suspended from the conclusion of racing on Monday 30 January 2006 until the conclusion of racing on Thursday 9 February 2006, effectively 5 days.
