Mr Knowles, stipendiary steward, alleged that with approximately 850 metres to run BEST CHANCE shied outwards checking JACCKA TWAIN, FIERY LAUREN, HILLVIEW GOLD, TOWN ICON and other runners. He sought disqualification of BEST CHANCE pursuant to R 1003.

Placings were 1, 10, 12, 7, 11, 8. The margins were: 8 ½ L; 1 ½ L; 1 ½ L.

Mr Knowles, had Mr Allison, stipendiary steward, demonstrate the incident on 2 videos. This showed that BEST CHANCE moved out suddenly with some 850 metres  to run and came into contact with JACCKA TWAIN, which was forced wider on the track. The field was disrupted with FIERY LAUREN breaking. Mr Knowles stated the make-up of the whole field had changed as a result of the incident and that was why he was seeking disqualification.

He called Mr Hayter, driver of JACCKA TWAIN, who said there had been contact from BEST CHANCE as that horse had suddenly moved outwards and that he had been forced to run wider on the track. He stated his horse was not travelling that well, but he believed the interference had cost him third.

Mr Williamson, the driver of FIERY LAUREN, said there was no contact. He said his horse, which broke, should not have galloped. When questioned by the Committee, he stated FIERY LAUREN would not have galloped without the incident unfolding in front of him.

Mr Todd, the driver of HILLVIEW GOLD said he suffered interference from the inside but that had not caused him to lose any ground.

--

Mr McDowell, the driver of TOWN ICON, said his horse had galloped off the gate and again in the home straight, which had significantly affected the chances of his horse. He believed these matters had had more impact upon his horse’s chances than had the disruption of the field by BEST CHANCE.

Mr Jones said his horse had shied at the Clerk of the Course, who was on the inside of the track. He agreed he had come into contact with Mr Hayter and had forced him wider on the track. He believed this was the only horse he had interfered with. He submitted the Committee could not be sure that JACCKA TWAIN would have finished 3rd.  He said the evidence from the respective drivers, other than Mr Hayter, suggested that it was not his horse that had disrupted the field.

We accept Mr Jones’s statement that BEST CHANCE shied at the Clerk of the Course. The result was outwards movement into the path of JACCKA TWAIN, which lost momentum and was forced very wide on the track. We are satisfied that FIERY LAUREN broke as a consequence of the movement from BEST CHANCE. Mr Williamson stated that FIERY LAUREN would not have broken had there not been the initial movement from BEST CHANCE.

On examination of the videos we are satisfied that FIERY LAUREN was following JACCKA TWAIN and, as that horse moved outwards, FIERY LAUREN initially went to follow it.  It was when Mr Williamson went to steady his horse and move back down inside Mr Hayter that FIERY LAUREN broke. Mr Williamson says the horse should not have broken. That may be so, but we note it is a three year-old, and FIERY LAUREN had had only two starts.

In exercising our discretion and disqualifying BEST CHANCE, we are satisfied that the breaking of FIERY LAUREN, the interference to the chances of JACCKA TWAIN, which finished 4th, and the disruption of the field occurred because of the outwards movement of BEST CHANCE after it had shied. We believe that BEST CHANCE set off a chain reaction, compounded by the fact that these were inexperienced three-year-olds, which had consequence that a number of horses had their chances affected and FIERY LAUREN had them extinguished.
