Following the running of Race 9, the Amateur Drivers Supporting Harness Mobile Pace, an Information Instigating a Protest was filed by Stipendiary Steward Mr N. M. Ydgren alleging a breach of Rule 869(8). The information reads as follows.
--“This is a protest by horse number (5) placed 8th by the judge against horse number (4) placed 2nd by the judge on the grounds of interference at the start.”

Following the running of Race 9, the Amateur Drivers Supporting Harness Mobile Pace, an Information Instigating a Protest was filed by Stipendiary Steward Mr N. M. Ydgren alleging a breach of Rule 869(8). The information reads as follows.
--“This is a protest by horse number (5) placed 8th by the judge against horse number (4) placed 2nd by the judge on the grounds of interference at the start.”
--Rule 869(8) reads as follows.
--“The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.”
Present at the hearing were Mr P. J. Robertson, the trainer and part owner of “Allergee”, and Mr L. L. Donald the driver of that horse. Mr R. J. Sissons, the driver of “Sunnivue Piper” (5), also attended the hearing, and he represented the interests of the owners and trainer of that horse.
Mr Sissons gave evidence that at the start of the race the outside wheel of Mr Donald’s sulky made contact with the front leg of his horse causing it to break and effectively lose its chance in the race.
--Mr Ydgren used video coverage to show the start of the race. While “Allergee” could be seen clearly, “Sunnivue Piper” was mostly hidden by the cab of the starter’s vehicle. It could be seen that there was contact as described by Mr Sissons.
--The video of the start was viewed on numerous occasions. It was clear that “Allergee” maintained a straight line up to the starting point, at which time it moved slightly towards the marker line, and away from “Sunnivue Piper”.
--Stipendiary Steward Mr McIntyre pointed this out. The Stipendiary Stewards then advised that they would not continue to support this protest. Mr Sissons was then asked if he wished to continue with the protest, and he said that he did not.
--Accordingly we dismissed the protest, and the judge’s placings were confirmed.
