Following Race 1, The Chef’s Choice 1340 Mr. R. Neal made a request for a ruling under rule 865 A which reads:

--

If, in the opinion of the Judicial Committee, a horse which does not finish in a dividend bearing position was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter and may make such order regarding betting as provided for in the NZRB Betting Rules.

MAID IN BERLIN and MINERS REST were denied a fair start and Stewards request that both those runners be declared late scratchings.

MAID IN BERLIN and MINERS REST were denied a fair start and Stewards request that both those runners be declared late scratchings.

Present throughout the hearing were the official starter, Mr. Brian Clements and Mr. Bill Thurlow trainer of MINERS REST.  Mr. Adams, trainer of MAID IN BERLIN was attending to the horse but arrived later.

Mr. Clements told the committee that Mr. Babbington reported that MINERS REST kicked out at the back gate of the starting stalls which was believed to have contributed to the solenoids locking.  Head and side on views of the start clearly showed that barriers 9 and 10 failed to open. The Stewards allowed the films to run through the initial stages of the race which showed no other horses being disadvantaged in any way.

Mr. Clements said that he did not activate the siren to declare a false start because he believed the current procedure was to let the race run.

The committee was left in no doubt that there was a mechanical failure of the starting gates which resulted in barriers 9 and 10 remaining closed after the start. MAID IN BERLIN and MINERS REST did not jump with the rest of the field and took no part in the race. The committee considered their chances were materially prejudiced and declared them non-starters.
