Following the running of race four on the programme, an Information was lodged against driver Mr D Corbett, alleging a breach of Rule 869(2)(a), in that he used his whip excessively



Following the running of race four on the programme, an Information was lodged against driver Mr D Corbett, alleging a breach of Rule 869(2)(a), in that he used his whip excessively in the run home when driving Direct Surprise. Mr Corbett admitted the breach and elected not to be present.

Presenting his case, Stipendiary Steward, Mr Ydgren, referred to the video of the race, which showed Mr Corbett (Direct Surprise) striking that horse 26 times in the last approximately 220metres. He said Mr Corbett has a very extravagant, rapid-fire action which further draws attention but, whilst he said he had also hit the dust sheet on occasions, he accepted that he had erred and was very remorseful.

In respect to penalty, Mr Ydgren said that Mr Corbett had not appeared previously, and he recommended a (moderate) fine.

In this case, driver Mr D Corbett, appears on a breach of Rule 869(2)(a), in that he used his whip excessively in the run home, on Direct Surprise. He admitted the breach.

The committee has been advised that Mr Corbett is remorseful and, this being the first time he has appeared, he is to be given some credit. With this in mind, and in the absence of personal submissions from Mr Corbett, the committee accepts the penalty submissions of the Stipendiary Steward are appropriate and a fine of $200.00 will apply.
