An information lodged by Stipendiary Steward, Mr J Muirhead, against Mr P Butcher, driver of WHAT YOU CALL, alleging a breach of Rule 869(3)(b) ? careless driving ? in that he drove his horse carelessly when he moved it outwards at the start of the race checking SUMMER MAN, driven by Mr D Gibbons, which broke and lost all chance.

Mr Butcher admitted the breach and was present at the hearing.

Mr Muirhead demonstrated the incident by use of the video film. Shortly after the start Mr Butcher moved his horse outwards to improve its position but then had to ease slightly and in so doing took the line of SUMMER MAN which then broke. Mr Muirhead said he was not sure whether or not there was contact or whether SUMMER MAN shied at WHAT YOU CALL. He said Mr Butcher was unlucky and that there was probably about "two inches in it." Mr Butcher said there had been no contact.

Penalty:

Mr Muirhead suggested a fine at the bottom end of the scale of $250-$500. He said Mr Butcher had an excellent driving record. Mr Butcher had no submissions on penalty.
