Defendant: Mr A Scobie, licensed horseman
Mr Scobie admitted a breach of R 869(2)(a) in that he used his whip excessively over the last 400 metres when driving PLUNDER BAY in Race 7 at the Winton HRC meeting on 3 March last.
--Mr Scobie was advised on raceday that he would be charged but failed to return to the stipendiary stewards’ room. Mr Scobie was served with the information by post and indicated he admitted the breach and did not wish to attend the hearing.
--Mr Allison demonstrated on the video that Mr Scobie had hit PLUNDER BAY in the straight on 26 occasions. We note there were 2 brief respites but the strikes were stronger as the horse neared the winning post. PLUNDER BAY finished 3rd.
--Mr Scobie drives rarely; with 7 drives this season, 12 the last, and 44 and 101, respectively, the 2 seasons before that. Mr Allison asked for a fine of $250 or a suspension of not less then 2 days.
--Mr Scobie has no breaches of this Rule the season but we are advised by the stipendiary steward that he has breached this Rule in the past 4 seasons. We take into account his admission of the breach.
--We believe a suspension by itself to be an inadequate penalty in light of the infrequency with which Mr Scobie drives. We suspend him from driving up to and including Saturday 20 March and fine him the sum of $200. He is reminded in strong terms of his obligations under the Rules of Harness Racing.
