Following the running of race 5 the Stipendiary Stewards lodged an information instigating a charge against Mr Grant alleging breach of rule 869 (3) (g)

DECISION & REASON
--Following the running of race 5 the Stipendiary Stewards lodged an information instigating a charge against Mr Grant alleging breach of rule 869 (3) (g). The Stipendiary Stewards alleged that Mr Grant (Starwood in Aspen) lost considerable ground at the start of the race and Mr Grant elected to progress three wide around the field after one lap, therefore, diminishing his horse's chances by offering her no respite at any stage of the race.
----At the outset of the hearing Mr Grant confirmed that he admitted the breach but did wish to be heard. The Stipendiary Stewards demonstrated the incident with use of the video evidence which confirmed the statement on the information.
----Mr Grant accepted that he was some distance behind the field and had moved round three wide but was unable to cross over to lead as his horse was hanging when going out of the straight. The horse eventually tired and when racing at the back of the field broke over the concluding stages.
----The Stipendiary Stewards, in respect of penalty, submitted that:

- The driver fell below a reasonable prudent driver standard ----
- Mr Grant had opportunities to make other decisions, and ----
- As a result of his decision his horse eventually broke and finished at the tail of the field. --

The Stipendiary Stewards also referred to the Menson decision given some three weeks ago at which time Mr Menson received a suspension of an effective six days driving.
----Mr Grant, for his part, acknowledged that a suspension was appropriate but asked that it be for the least possible number of days.
----The Committee finds the charge proven and in respect of penalty believes that a significant suspension is appropriate and, accordingly, Mr Grant's licence is suspended from the completion of racing on 19th December 2006 until the completion of racing on 26th January 2007 (an effective 6 days on the race days Mr Grant indicated that he would be driving at).
