Following the running of race 5 an information was laid by Stipendiary Steward Mr R Neal under Rule 530 (2) (6) alleging that Mr T Ihaka, rider of LOGAN JAMES, used his whip excessively prior to the 200 metres.

Mr Neal read the relevant rule and defendant Mr T Ihaka confirmed he understood the rule and that he admitted the charge.
The film of the incident was shown and commented on by both parties. Mr Neal believed the guidelines were exceeded by Mr Ihaka’s actions as the horse was struck approximately 11 times without relief.
Mr Ihaka agreed that the guidelines were exceeded and that it did not look good.
SUBMISSIONS ON PENALTY
--Mr Neal confirmed that Mr Ihaka had never appeared under this rule before. He has limited opportunities and rode only in jumping and high weight races. He believed the offence was about mid range but confirmed it did sit outside the guidelines. He asked for a monetary penalty of between $150 and $250. Mr Ihaka had no comment.
--DECISION & REASON
--This committee concurs with Stipendiary Steward Mr Neal that that this charge sits in the mid range. The guidelines are there (Mr Ihaka) to protect the image of racing. We have taken into account that this is your first charge under this rule and that you admitted the breach. This committee fines you the sum of $175.
