Decision:

Following the running of race 4 on the programme, an Information was lodged against Mr A Veint, the driver of Stormy Seas, alleging a breach of Rule 869(3)(b), in that he drove carelessly when allowing Stormy Seas to run out causing interference



Following the running of race 4 on the programme, an Information was lodged against Mr A Veint, the driver of Stormy Seas, alleging a breach of Rule 869(3)(b), in that he drove carelessly when allowing Stormy Seas to run out causing interference to Lady Bess and Artenis Fleet.

Mr Veint admitted the breach and elected not to be present.

This matter results from a successful protest hearing and stipendiary steward, Mr Ydgren, alluded to the evidence presented at that hearing. He reminded the committee of the circumstances, in that Mr Veint, driving Stormy Seas, allowed his horse to run out in the run home, causing interference to both Lady Bess and Artenis Fleet. He said that, at no stage, did Mr Veint attempt to correct his horse but he continued to drive it out to the winning post.

In respect to penalty, Mr Ydgren said that Mr Veint had a previous breach under this Rule at Geraldine in December but, otherwise had a good record and had not previously been before the committee. In this case, he had admitted the breach and was very frank in his admissions, accepting responsibility. Mr Ydgren considered a fine of $250.00 appropriate, a penalty Mr Veint had accepted as being recommended.
