An information was filed following race number two alleging a breach of rule 869 (3) (b) the informant was Mr.T.W.Taumanu and the information alleged that Mr.G.Martin the driver of "BETTOR’S STAR , drove carelessly when he improved this horse three wide with approximately 500 to run tightening "JUST SHOOT ME", down on to "REPUBLICAN", who was forced over the pylons.

--Mr.Taumanu in submissions on penalty sought a three day suspension of Mr.Martin’s, horseman’s licence .
--Mr Martin stated that he agreed with Mr Taumanu and was happy to accept a suspension in this instance.

--Having taken into consideration the fact that Mr.G.Martin admitted the breach of the rule and has a clear driving record this Judicial committee imposes a suspension of Mr.Martins horseman’s licence from the close of racing on the 18th January 2009 to the close of race on the 29th January 2009.
