Hearing Type:

Rules:
871.1.d

Hearing Type (Code):

Decision: --

Following race 9 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendary Steward Mr J Oatham, that Mr T Harris, rider of SKEETA allowed his mount to shift inwards near the 50 metres when not sufficiently clear

--

Following race 9 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendary Steward Mr J Oatham, that Mr T Harris, rider of SKEETA allowed his mount to shift inwards near the 50 metres when not sufficiently clear of OUR GENES (M Sweeney) who was checked.

--

Mr Harris, who was represented by Mr N Harris, admitted the charge.

--

Mr G Stewart demonstrated the video of the race as it progressed down the home straight. He showed where Mr Harris's mount SKEETA, after being hit with the whip, started to run in towards the rail. He showed Mr Harris straightening his mount before producing his whip again. SKEETA again ran in but this time Mr Harris did not attempt to straighten his mount. This incident took place approximately 50 metres from the winning post.

--

As Harris admitted the charge the committee has to adjudicate on penalty only.

--

PENALTY:

--

Mr Oatham gave Mr Harris' record which includes a recent 5 day suspension with a $1000 fine. He said that although this was an offence at the lower end of the scale he asked for a suspension.

--

Mr Harris indicated that he rode extensively over the North Island.

--

In coming to our decision the committee has taken into account:

--

1/ Mr Harris' record.

--

2/ The severity of the offence.

--

3/ The admission of guilt.

--

The committee expresses concern with Mr Harris' growing record and also notes that in this case his mount had given him a warning of its inclination to run about. We also point out that it was only the distance of the finishing margins that discouraged a protest being entered.

--

Accordingly we suspend Mr T Harris from riding from after the completion of racing on 2 May till the completion of racing on 10 May ? 3 days.

--
