Following the running of Race 4, the Victory Lime Ltd Maiden, Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 871(1)(d) alleging careless riding by Apprentice Jockey Miss C. L. Spittles.

DECISION AND REASONS:
--Following the running of Race 4, the Victory Lime Ltd Maiden, Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 871(1)(d) alleging careless riding by Apprentice Jockey Miss C. L. Spittles.
--The information reads as follows.
------"I the abovenamed informant allege that the abovenamed Defendant committed a breach of Rule 871(1)(d) in that C. Spittles rider of Oodles allowed her mount to drift outwards inside the 400mts causing interference to Secret Halo (J. Bates) and De Goals (M. Walker)"
--Rule 871(1)(d) reads as follows.
--"(1) Every rider commits a breach of these Rules who in the opinion of the Judicial Committee is guilty of riding which was:
--(d) Careless'."
--Miss Spittles had indicated on the information that she did not admit this breach of the Rules and she confirmed this at the hearing. Miss Spittles was assisted by her employer, Mr J. F. Parsons.
--Jockey J. C. Bates gave evidence that with about 400 metres to run there was a gap between "Oodles" ridden by Miss Spittles, and "De Goals", ridden by Mr M. J. Walker. When he rode his horse into the gap Miss Spittles came outwards a little closing the gap, and this resulted in interference to his horse, and also to Mr Walker's horse.
--Mr Ching illustrated the incident by means of video coverage. He pointed out where Mr Bates had a gap to move in to, and where the gap closed after Miss Spittles allowed her horse to move outwards. It could also be seen that there was contact between Mr Bates' horse and the horse ridden by Mr Walker.
--On behalf of Miss Spittles Mr Parsons disputed that Mr Bates had a gap to move into. He put this question to Mr Bates who was firm that he did in fact have a gap available to him. Mr Parsons did agree that Miss Spittles had moved outwards half a horse width on the point of the turn, and that this was due to the "greenness" of "Oodles". Mr Parsons repeated that he disputed Miss Spittles' actions had caused interference to Mr Bates.
--After hearing the evidence we adjourned to consider our decision. We were satisfied that Miss Spittles had in fact allowed her horse to move outwards as alleged. We were also satisfied that Mr Bates had a gap to move in to as he had stated. On returning to the Enquiry Room we gave the following oral decision.
--"Having heard the evidence and having seen the video coverage of this incident we are satisfied that Jamie Bates on "Secret Halo" did have a gap to move into. We are also satisfied that Miss Spittles on "Oodles" allowed her horse to roll outwards, causing interference to "Secret Halo". We find that the interference to Mr Walker was also quite clear from the evidence, but this only relates to the initial incident. So we find the charge proved."
--Penalty: Mr Ching advised that Miss Spittles had four previous convictions for careless riding in the last 12 months, and her last breach was in April 2007, or five months ago. Mr Ching said he believed that a suspension was called for in this case.
--Mr Parsons said that this was a difficult time for a trainer to lose the services of a jockey as it was a build up time to cup week. Mr Parsons asked that a fine be considered. It was also established that Miss Spittles only rides in the South Island.
--We adjourned to consider the question of penalty. We were satisfied that although the movement by Miss Spittles was small the consequences were such that this was a relatively serious breach of the Rule. On the other hand we took note that Miss Spittles had been convicted of careless riding on 4 occasions in a 6 month period between October 2006 and April 2007, but had not offended for the last 5 months.
--Taking all these matters into account we decided that a suspension was appropriate, and on returning to the Enquiry Room we advised that Miss Spittles was to be suspended for 3 weeks from after the completion of racing on 28 September 2007 until after the completion of racing on 19 October 2007. This period included 3 South Island riding days.
