Under Rule 869 (3) (b) Stipendiary Steward Mr P T Knowles alleged that "R M Tither drove carelessly when allowing DAISY'S DREAM to run inwards
Under Rule 869 (3) (b) Stipendiary Steward Mr P T Knowles alleged that "R M Tither drove carelessly when allowing DAISY'S DREAM to run inwards with approximately 50 metres to run checking CYNICAL VIEW, driven by C J Barron, causing that horse to break".
--It was agreed by all parties that evidence given in the protest into DAISY'S DREAM 2nd placing be taken as read in this hearing.
--Mr Knowles again showed the video and said that Mr Tither's horse had drifted out and when it was hit on the right hand side began to run in sharply. Mr Knowles said it was the fact that Mr Tither continued to hit the horse that had largely contributed to the incident.
--As Mr Tither admits the charge I find it proven under Rule 1111 (1) (d).

PENALTY
--Submissions as to penalty were heard. Mr Knowles said Mr Tither's record was that he had two charges under this rule upheld since February. He had firstly been fined $275 and then had a two day suspension. Mr Knowles asked for a 3 - 4 day suspension. Mr Tither felt that was fair but preferred a fine if possible. He said he had an engagement on 1 December 2007 at Geraldine.
--Giving credit for his admission but finding that this was very careless driving, I suspend Mr Tither's licence up to and including 1 December 2007, which is a four day period including Timaru and Geraldine.
