Following race one an information was filed pursuant to Rule 876(1) when it was alleged by the Stipendiary Steward, Mr Coles, that ROYAL KEEL placed first by the Judge interfered with the chances of SCISSORMAN placed third by the Judge.

Following race one an information was filed pursuant to Rule 876(1) when it was alleged by the Stipendiary Steward, Mr Coles, that ROYAL KEEL placed first by the Judge interfered with the chances of SCISSORMAN placed third by the Judge.

The margin between first and second was 1 ? lengths and between second and third a nose.

Mr Oatham demonstrated both video films and showed where ROYAL KEEL moved out into the line of SCISSORMAN approximately 50 metres from the post.

Mr Gedge, rider of SCISSORMAN, said that ROYAL KEEL came out into his line and he had to stop riding for approximately 5 strides.

--

Mr Scott, part-owner of SCISSORMAN, agreed with Mr Gedge and believed it cost his horse a better placing.

--

Mr Donnison, trainer of SCISSORMAN, demonstrated the movement on the video, the horses involved and confirmed Mr Gedge's and Mr Scott's evidence.

Mrs McGlade, trainer of ROYAL KEEL, said that if SCISSORMAN had kept a straight line from the last fence that would have allowed for the outward movement of ROYAL KEEL.

Mr Coles in summing up said there was movement from ROYAL KEEL but the Committee had to take into account the margin at the post and the way the horses were finishing.

The Committee considered all evidence and carefully reviewed the video films. While agreeing there was outward movement from ROYAL KEEL onto SCISSORMAN there was also inward movement from SCISSORMAN which contributed to the inconvenience he suffered. Added to this was the manner in which BENCHARK, the second horse, was finishing off the race and coming from behind SCISSORMAN. Accordingly and for these reasons we apply our discretion and dismiss the protest. The Judge's placings shall stand.
