DECISION AND REASONS:
--Following the running of Race 7, Nat Hall Memorial Handicap Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Trainer, Mr G R Payne, alleging that the sulky seat on IDANCEDALLNIGHT (B N Orange), trained by Mr Payne, came adrift in the running.
--Mr Orange, driver of IDANCEDALLNIGHT, had signed the Statement of Defendant endorsed on the information form as "agent for G Payne" and acknowledged that the breach was admitted and, further, that Mr Payne did not wish to be present at the hearing of the information.
--Mr Williams informed the Committee that the sulky seat had worked loose during the running of the race and Mr Orange had removed it and thrown it to the inside of the track. She recommended a fine of $100.
--The charge was found to be proved on the basis of Mr Payne's plea of guilty, through Mr Orange, and Mr Payne was fined the sum of $100.00.
