Decision: Following the running of Race 6 Mr S Doyle was charged with careless riding under rule 871 (1) (d).

Following the running of Race 6 Mr S Doyle was charged with careless riding under rule 871 (1) (d).  The information alleged S Doyle directed his mount inwards when not clear of DODGEMALLYOULIKE resulting in that runner having to be checked and lose its rightful running near the 400m.

Mr Doyle admitted the breach and was represented by Mr Donovon.

Mr Ray (Stipendiary Steward) pointed out the incident on the available films.  He demonstrated Mr Doyle riding SMOKING CHIMNEYS with two horses on his inside, one of which was David Walker riding DODGEMALLYOULIKE.  As Mr Doyle improved around these horses he directed his horse inwards when not sufficiently clear causing a severe check to Mr D Walker.

Mr Goodwin told the committee that Mr Doyle had two suspensions last year for careless riding:

--

20/5/07            Egmont           3 days

--

14/4/07            Manawatu       3 days.

He also said that Mr Doyle had been away from riding for two and a half months due to weight problems.

--

Mr Donovon confirmed this by saying that Mr Doyle’s employer, Mr John Wheeler, had paid for a diet to help him lose the weight that he had gained.  This was only Mr Doyle’s second day back riding and he had been on the favourite for the race.  His horse was traveling very well and he was looking for room to move forward.

 Mr Donovon said that a suspension would be difficult for Mr Doyle’s weight issues and asked if the committee would impose a fine instead.

Mr Goodwin submitted that the incident was of sufficient severity to warrant a term of suspension.

Mr Doyle told the committee that he has rides at New Plymouth on Saturday 16th February and that if he were to incur a suspension requested that it be deferred until after that date.  He added that he rides throughout the North Island.

It was the opinion of the committee that due to the nature of the interference suffered by Mr Walker penalty does have to be by way of suspension.  In determining the length of the suspension the committee took into account Mr Doyle’s admittance of the breach, his good riding record and Mr Donovon’s comments about the weight issues suffered by Mr Doyle.

He is suspended from riding from the conclusion of racing on Saturday 16th February until the conclusion of racing on Friday 22nd February, in effect three riding days.
