Following the running of Race 8 Steelform Roofing Group Waverley Gold Cup the Stipendiary Steward lodged an information under rule 871 (1) (d) in that Bruce Herd the rider of Thee Auld Hussie has allowed his mount to move inwards when not the required distance

Following the running of Race 8 Steelform Roofing Group Waverley Gold Cup the Stipendiary Steward lodged an information under rule 871 (1) (d) in that Bruce Herd the rider of THEE AULD HUSSIE has allowed his mount to move inwards when not the required distance causing interference to MILES (K.Collins) and PENTATHON (D. Walsh) at the winning post with a round to go.

Mr Herd confirmed that he did not admit the breach of this rule.

Mr D Walsh stated approaching the winning post with a round to go and travelling off the fence he received pressure from his outside by MILES and one other horse outside which was THE AULD HUSSIE ridden by B Herd. It got very tight and he received a bad check costing him two to three lengths.

Mr K Collins confirmed he received pressure from Mr Herd on his outside. He stated that his horse had his head in the air.

Mr Goodwin demonstrated with the head and side on films Mr Herd angling his mount in, looking, and continuing to move in when not clear of MILES who moves into PENTATHON causing him to become caught between JAUNT racing on the rails and MILES. This resulted in interference to MILES and a severe check to PENTATHON at the winning post with a round to go.

In defence Mr Herd stated approaching the winning post with a round to go he had moved in about three to three and a half off the fence. Mr Collins rider of MILES called. Mr Herd relieved the pressure, moved in and then out again. Both horses were over racing with MILES tossing his head about.

He then had no option, he couldn?t go anywhere. Mr  Smith's mount JAUNT had moved out slightly off the rail, which was only marginal but was enough to contribute to the incident.

Mr Herd at this point he indicated that he may wish to call a witness.

Mr Goodwin in summarising clarified the incident started and was completed before the turn. There was quite severe tightening to those runners before they got to the turn. Before they go round the corner Mr Walsh was pushed out the back.

All endeavours were made to contact K Smith. At this point Mr Herd stated he did not require Mr  Smith as a witness.

In reaching their decision the committee have taken into account the inwards movement by THEE AULD HUSSIE onto MILES and to PENTATHON who received a severe check. Whilst there may have been some relief given by Mr Herd the incident and the concertina affect had already begun.

The committee find the charge proven.

Penalty:

Submissions as to penalty indicated by Mr Goodwin are a warning and two previous charges but over all a very good record however a term of suspension is warranted.

Mr Herd stated he would prefer a deferred penalty or a fine as he has commitments at Manawatu.

--

After hearing all submissions in regard to penalty the committee have taken into account Mr Herd's good riding record in the current year and the consequences of his actions causing interference to MILES and PENTATHON. The committee have also considered the request for a deferred penalty or penalty by way of fine, however, on this occasion the committee support a term of suspension befitting the severity of the interference. Therefore Mr Herd is suspended from riding from the close of racing on Saturday 24th March up to the conclusion of racing on Thursday 5th April. (3 days)
