Following the running of race No.3 , an information was filed instigating a protest.
--The judge's placings were 1st No 13, 2nd No 6, 3rd No 10, 4th No 9, 5th No 12, 6th No 14.
--Mr. Muirhead laid this information against horse number 12 Shebar Invasion, driven by Mr. C J DeFilippi, on the grounds that Shebar Invasion was in breach of rule 870 in that this horse had galloped for a distance of in excess of 50 meters in the run home.
--This protest was not contested by the trainer Mr. F Kirk. Mr. Kirk was not present at the hearing of this information.
--Mr. Muirhead showed the video of the run home and this clearly showed Shebar Invasion to be in its incorrect gait for a distance of in excess of 50 meters in the run home. Mr. Muirhead sought disqualification of Shebar Invasion from 5th place.
--Decision And Reasons.
--Having viewed the video of this incident and taking into consideration that this protest was not contested by the connections of Shebar Invasion this protest is upheld.
--This Judicial Committee orders that Shebar Invasion be disqualified from 5th place and the judges places shall now read 1st No 13, 2nd No 6, 3rd No 10, 4th No 9, 5th No 14, 6th No 7. .
