An information was lodged by the Stipendiary Stewards instigating a charge against Mr M Pitman under Rule 508 (2) (5) alleging that Mr Pitman failed to declare a rider for COOP PIE in race 6 at the meeting by the required time.

An information was lodged by the Stipendiary Stewards instigating a charge against Mr M Pitman under Rule 508 (2) (5) alleging that Mr Pitman failed to declare a rider for COOP PIE in race 6 at the meeting by the required time.
--Stipendiary Steward Mr Ching advised the Committee that the declaration of riders was due at 1.00 pm 26th December and the rider for COOP PIE was not declared until 12.01 pm on 27th December 2007.
--Mr Pitman said that the horse had raced previously five days earlier on a heavy track and he wanted to ascertain the condition of the track prior to declaring a rider. He called at the track on 26th December 2007 and inspected the track, which he was still concerned about, however, he again checked the track on 27th December 2007 and then declared a rider for COOP PIE. He said he was trying to do the right thing for the connections and the betting public.
--Mr Pitman also made statements regarding the conditions of tracks and readings given, however, he was advised by the Committee that this was not the forum for those to be considered and he should make representation to the appropriate parties.
--Having given consideration to the matters before the Committee, the Committee finds the charge proven. In arriving at this decision the Committee took into account Mr Pitman's own submission regarding the decision to delay declaring the rider for COOP PIE until he had ascertained the state of the track prior to race day. Mr Ching asked for a monetary penalty while Mr Pitman asked the Committee to impose no penalty.
--Normally in a defended hearing of this type this Committee would have imposed a fine of $100.00 but after giving Mr Pitman credit for his good record in respect of this rule over the last 12 months a fine of $50.00 is imposed.
