An information alleging a breach of Rule 869 (3) (b) was lodged against Horseman Mr G MARTIN by Stipendiary Steward Mr J MUIRHEAD.

Mr MARTIN was charged with driving BEST TO LIVE carelessly causing a check to RAINING THUNDER (R DOWNEY) which resulted in interference to I DREAM?T IT (C GILLIES) shortly after the start of

Mr Martin denied the charge and was present for the Hearing

--

Mr Muirhead gave evidence referring to video footage at the start of the race. He said that Mr Martin starting from barrier 4 had moved across to the rail too quickly shortly after the start of the race causing a check to Raining Thunder which in turn interfered with I Dream?t It

He said that Miss Chilcott moving across from barrier 6 had shown more correctly how the movement should have been made

--

Cross examined by Mr Martin, Mr Muirhead conceded that Raining Thunder appeared to have shied into interfering with I Dreamt It but this appeared to be as a result of Mr Martin's sharp inwards movement.

Mr Downey gave evidence that shortly after the barrier start Mr Martin came sharply across his path, he called for room before his horse shied and moved inwards onto I Dreamt It, causing interference..

Although his horse shied away from Mr Martin's path he said that if he had maintained his line Mr Martin would have taken his legs out.

--

In his opinion Mr Martin had moved across too sharply without giving him sufficient room. He had called for room and had to take hold of his drive which moved down onto I Dreamt It causing that horse to break.

Cross examined by Mr Martin, Mr Downey admitted his horse had shied away from Mr Martins and that there had been no contact. He also admitted that his horse was inexperienced but had qualified nicely.

Mr GILLIES gave evidence and said that his drive I DREAMT IT broke and galloped shortly after the start of the race when Raining Thunder moved into him.

He didn?t see any reason for this interference but was definite that contact was made before his horse broke up. He did not see Mr Martin before the interference occurred.

Mr Muirhead submitted that the Video footage reinforced by the witnesses account clearly showed Mr Martin had crossed too quickly, and this action when looking at the horses relative positions had been careless.

Mr Martin submitted that there had been interference to I Dreamt It but that he had been sufficiently clear when he made his move and that the interference had been caused by a green horse.

Decision

The charge is established. I am satisfied that Mr Martin's early movement was made when he was not sufficiently clear of Raining Thunder. This is demonstrated by both the Video footage and the witness's accounts reinforced by Mr Downey calling for room just before his drive came down on and into contact with I Dreamt It.

Following submissions on Penalty and taking into account Mr Martins clean driving record, his driving commitments and the offending being at the lower end of the scale his driving licence is suspended from after the final race at Auckland on 31st December 2005 to after the last race on Friday 6th January 2006
