Rule 869 (2) (a) : Senior Stipendiary Steward Mr N ESCOTT laid an information charging Junior Horseman Mr B JONES with using the whip unnecessarily on Empire King in Race 11.

Senior Stipendiary Steward Mr N ESCOTT laid an information charging Junior Horseman Mr B JONES with using the whip unnecessarily on Empire King in Race 11.
--Mr Jones, supported by Senior Horseman Mr R LAWSON, admitted the charge.
--The Committee heard from the Stipendiary Stewards and viewed footage of the start of the race which indicated Mr Jones striking his drive between 5 and 10 times immediately prior to the start of the race. Mr Escott suggested the horse was fractious but the manner the whip was employed was excessive and the wrong way to square the horse up prior to the start of the race. Mr Jones had displayed his frustration.
--Mr Lawson on behalf of Mr Jones submitted the horse was extremely recalcitrant and needed something to get it on the right path. Mr Jones had hit it with the back side of the whip. In mitigation Mr Lawson submitted that Mr Jones had pleaded guilty to the charge, was an active junior driver with a very god record who had never appeared before.
--Mr Escott recommended a fine of $200 on a guilty plea.
--Taking into account the facts and submissions of both parties a fine of $200 was ordered.
