Following race 5 an information was filed pursuant to Rule 871(1)(d). The informant, Mr J Oatham, alleged that Mr T Harris permitted his mount TELE COMBO to shift inwards after the start when not sufficiently clear of I’M JAKE (K Hercock) who was checked.
Following race 5 an information was filed pursuant to Rule 871(1)(d). The informant, Mr J Oatham, alleged that Mr T Harris permitted his mount TELE COMBO to shift inwards after the start when not sufficiently clear of I’M JAKE (K Hercock) who was checked.
Mr Harris admitted the breach.
--Mr Coles demonstrated the video films and pointed out to the Committee, Mr Harris riding TELE COMBO shift inwards approximately 100 metres after the start. Mr Coles said Mr Harris was only three-quarters of a length clear of I’M JAKE when he moved in which caused Miss Hercock to check and lose approximately 1 – 1 ½ lengths.
--Mr Harris said it was the first time his mount had raced in blinkers and he was racing greenly. He believed Miss Hercock had over-reacted.
--PENALTY SUBMISSIONS:
Mr Oatham said Mr Harris had a good record with two suspensions in the last 12 months. He submitted this was at the lower end of carelessness.
Mr Harris told the Committee he only had commitments until this Friday, 21.8.09.
PENALTY:
The Committee considered all evidence and submissions, and before imposing an appropriate penalty took into account the following:
1. Mr Harris’ record which is a good one.
2. His guilty plea.
3. Level of carelessness which we consider to be low.
Accordingly we impose a suspension on Mr T Harris from riding in races which is to start after racing on 14 August 2009 and conclude after racing on 21 August 2009 (four days).
