--This is an information instigating a protest filed by Stipendiary Steward Mr J. Muirhead on behalf of KUBLA KHAN driven by Mr F. Cooney and placed 8th against MAJOR OBSESSION driven by Mr K. Barron placed 3rd on the grounds of interference just after the start of the race.

--This is an information instigating a protest filed by Stipendiary Steward Mr J. Muirhead on behalf of KUBLA KHAN driven by Mr F. Cooney and placed 8th against MAJOR OBSESSION driven by Mr K. Barron placed 3rd on the grounds of interference just after the start of the race.
--Mr Barron who was also the trainer of MAJOR OBSESSION represented the connections of that horse.
--Mr Muirhead showed the video film of the incident. Shortly after the start MAJOR OBSESSION moved inwards and forced KINGS RANSOM driven by Mr T. Herlihy inwards and that horse then made contact with KUBLA KHAN which broke and lost its chance. Immediately prior to the start both KUBLA KHAN and KINGS RANSOM were not right up on the barrier.
--Mr Herlihy gave evidence and agreed with the evidence of Mr Muirhead. He said contact was made with the front legs of KUBLA KHAN.
--Mr Cooney gave evidence and he also agreed with the evidence of Mr Muirhead and Mr Herlihy.
--Mr Barron in essence accepted the evidence in support of the protest. He said that his horse had run away from GOTTA GO BARNETT which had headed him out of the barrier and then crossed over in front of him. He pointed to some outward movement by OHOKA’S BONDY which had drawn barrier position one. He agreed that any outward movement did not entitle his horse to move inwards as it had done.
--Decision:
--The video film is quite clear. The inward movement of MAJOR OBSESSION has resulted in the interference to KUBLA KHAN which broke and lost all chance. The Committee does not consider the outward movement of OHOKA’S BONDY to have contributed to the interference to KUBLA KHAN. The Committee accepts that the fact that KUBLA KHAN and KINGS RANSOM were not right up on the barrier did not help but that is no defence to the inward movement of MAJOR OBSESSION. The protest is upheld and MAJOR OBSESSION is disqualified – it has breached Rule 869(4A) and the disqualification is pursuant to Rule 1003 (2)(a).

3rd – KING’S RANSOM
4th – DAN’S GAMBLE
5th – GOTTA GO BARNETT
