Mr Knowles, stipendiary steward, alleged that Ms Ottley drove carelessly when shifting outwards on BREENY’S LUCK with resulting interference to FRANCO TRANSIT causing that horse to break with approximately 300 metres to run. Ms Ottley has admitted the breach, which we thus find proved.
--Mr Knowles had Mr Allison, stipendiary steward, demonstrate the incident on the videos. These showed that when Ms Ottley moved wider on the track, looking for a run, she interfered with FRANCO TRANSIT, which in turn shifted out, broke, and inconvenienced horses on its outer. Ms Ottley said Mr Todd, whose horse was tiring, had called out to her, “Way you go, Sam” and had given her room. Mr Knowles said Ms Ottley’s carelessness lay in the fact that she moved out too quickly and half a cart too far. He described the breach as being at the lower end.
--Mr Jones spoke on Ms Ottley’s behalf, and agreed with Mr Knowles’ assessment of the gravity of the breach. He said that had Mr Dunn, who was racing wider on the track, not been half a length in front of the horses on his inner there would have been room for them all to have moved wider on the track. Mr Jones asked that Ms Ottley be given only an official warning.
--This is Ms Ottley’s first breach of this rule in 2 seasons of driving. She said she has had over 30 drives this season. She has readily admitted the breach. We agree it is at the lower end for a breach of the rule. She is accordingly fined $200 and reminded of her obligations.
