Decision:

Following Race 6 an Information was filed pursuant to Rule 330 (3) (C).  The Informant, Mr Oatham, alleged that Mr Dalley, rider of CALIBRATE in Race 6, failed to make the contracted weight.

Following Race 6 an Information was filed pursuant to Rule 330 (3) (C).  The Informant, Mr Oatham, alleged that Mr Dalley, rider of CALIBRATE in Race 6, failed to make the contracted weight.

Mr Dalley admitted the breach.

Mr Oatham said Mr Dalley was down to ride at 54 ½ kilos but was entitled to a 3 kg claim.  However on weighing he found he could only make a weight reduction of 1 ½ kilos.  Mr Oatham said at this stage it was too late to find a replacement rider.

Mr Marsh said he had been talking to Mr Dalley’s employer, Mr James, who told him Mr Dalley had been sick but thought he would be close to the book weight.  Mr Marsh, while not happy about the extra 1 ½ kilos, agreed Mr Dalley could ride the horse.

Mr Dalley confirmed that he had been sick but was confident of making the weight.

PENALTY SUBMISSIONS

Mr Oatham submitted Mr Dalley does struggle with his weight and had incurred 1 previous charge under this rule on 19 June 2009.  He submitted a fine of $150 - $200 would be appropriate.

PENALTY

--

The Committee considered all the evidence and submissions.  The mitigating factors of Mr Dalley’s guilty plea and his sickness were taken into account.  In this case Mr Dalley had not informed the stewards early enough of his weight problem which, had he done so, would have enabled a replacement rider to be found.

--

Accordingly we impose a fine of $175.
