Following Race 7 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Senior Stipendiary Steward, Mr C George, that CALVEEN, ridden by Mr V Colgan shifted out at the 350 metre mark when not clear of GEORGEOUS GEORGE

Following Race 7 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Senior Stipendiary Steward, Mr C George, that CALVEEN, ridden by Mr V Colgan shifted out at the 350 metre mark when not clear of GEORGEOUS GEORGE, ridden by Mr A Peard.

Mr Colgan admitted the breach.

Mr Coles demonstrated the race videos and showed CALVEEN shift outwards at the 350 metre when only approximately three-quarters to one length clear of GEORGEOUS GEORGE, which was tightened for a few strides.

Penalty:

Mr George produced Mr Colgan's record, which showed one breach on 11 November 2006 which earned him a three-day suspension. Mr George reminded the committee that this was a Group 1 race and that GEORGEOUS GEORGE did receive a check. He submitted a suspension between 4 and 6 days would be appropriate.

Mr Colgan said he believed a 3-day suspension was appropriate because any longer he would miss the entire Auckland carnival.

The committee considered all submissions and in reaching a fair decision have to account the following matters ?

  7. The actual interference suffered by GEORGEOUS GEORGE.

In the circumstances and taking into account we believe a 4-day suspension is appropriate. We have also considered two premier days fall within this period. Accordingly, we impose a suspension to begin after racing on the 27th of December 2006, up to and including 1st of January 2007 (4 days).
