An information was filed following race number 10,  instigating a protest.  The informant was Mr.T.W.Taumanu and this was a protest by horse number 9 SOUND OF THUNDER, placed 3rd by the judge against horse number 3 ANOTHERCHRISTIAN, placed 2nd by the judge on the grounds of a breach of rule 869 causing interference on the home turn.



An information was filed following race number 10,  instigating a protest.  The informant was Mr.T.W.Taumanu and this was a protest by horse number 9 SOUND OF THUNDER, placed 3rd by the judge against horse number 3 ANOTHERCHRISTIAN, placed 2nd by the judge on the grounds of a breach of rule 869 causing interference on the home turn.

The judges placings for this race were 1st No 5, 2nd No 3, 3rd No 9, 4th No 2, 5th No 10, 6th No7.

Present at the hearing of this information were Mr P.C.Ferguson the driver of Anotherchristian, Mr.T.Mitchell the driver of Sound Of Thunder , Mr K.Smith the trainer of Anotherchristian.  Also present was Mr I.Small the representative for Roman Conqueror.

Mr Muirhead showed the video of the alleged incident and identified the relevant horses involved this clearly showed Anotherchristian to duck out on the apex of the turn and make contact with Sound Of Thunder causing sound Of Thunder to break for two strides and run out forcing Roman Conqueror and Palomine  wider on the track.

Mr Ferguson in his evidence stated that his horse had caught him by surprise and ducked out and had made contact with Sound Of Thunder, Mr Mitchell agreed that this had happened and it was one of those racing incidents.  Mr Small when questioned stated that Roman Conqueror was flat on the turn and although forced wider on the track,  in his opinion he would not have been in the finish.

Mr Taumanu sought a change of placings between the 2nd and 3rd horses as interference had taken place and Sound Of Thunder had been forced wider on the track and had been forced off stride in this incident.

Having viewed the video of this incident and heard the evidence from Mr Ferguson, Mr Mitchell Mr.Muirhead and Mr.Taumanu this protest is upheld.

I find that Anotherchristian did duck out for a stride on the apex of the bend and make contact with the hind legs of Sound Of Thunder causing this horse to go off stride and force this horse wider on the track.  Under the provisions of rule 1003 I order that the 2nd and 3rd placings of Anotherchristian and Sound Of Thunder be reversed.

The amended placing shall now read 1st No 5, 2nd No 9, 3rd No 3, 4th No 2, 5th No 10, 6th No 7.
