Information No. 67824 was filed by Stipendiary Steward, Mr S P Renault, against Holder of License to Train, Mr J D Baikie, alleging a breach of Rule 865 (2) in that he “failed to submit a notifiable gear form by the required time of 1pm 8/4/09 (driver notification form) for CORPORAL”.

Information No. 67824 was filed by Stipendiary Steward, Mr S P Renault, against Holder of License to Train, Mr J D Baikie, alleging a breach of Rule 865 (2) in that he “failed to submit a notifiable gear form by the required time of 1pm 8/4/09 (driver notification form) for CORPORAL”.

Mr C L E Kennett, as agent for Mr Baikie, had signed the Statement by the Defendant on the information form indicating that the breach was admitted and that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 865 provides as follows:
(2) A horse may race with different gear from its last start when the owner, trainer or person in control of the horse has notified the change in the manner prescribed in the Approved Gear Regulations. Any such change is to be advised not later than the official time for notification of drivers as specified in the Notification of Drivers Regulations.

Mr Renault stated that it was observed in the birdcage prior to Race 7 that CORPORAL, trained by Mr Baikie, was wearing ear plugs and half blinds neither of which had been notified. Mr Baikie had told the Stewards that he was unaware of the requirement to complete and submit a gear notification form.

Mr Renault recommended a fine of $50.

Mr Baikie was fined the sum of $50.
