DECISION & REASON:

After race 3 a protest was lodged by T Wenn, trainer of OH BUOY pursuant to Rule 876(1). It was alleged that BROOKBY ridden by M Innes placed second interfered with the chances of OH BUOY placed fourth. The interference was alleged to have occurred in the final 200 metres of the race.

The official margin between third and fourth placing was ? of a length.

Mr T Wenn alleged that the second horse BROOKBY interfered with the chances of his horse namely OH BUOY ridden by C Anderson.

Ms L Sullivan represented BROOKBY.

--

Mr T Wenn first demonstrated on the film (head-on) his horse suffering interference at the 200 metre mark caused by BROOKBY?S movement. He claimed that his horse lost momentum and finished well. He submitted that his horse would have run third.

Ms C Anderson confirmed Mr T Wenn's evidence and said the interference had cost her one length.

Mrs Innes, rider of BROOKBY, gave evidence. She said that interference was minor and that OH BUOY was "battling".

The margin between third and fourth was ? of a length.

After hearing the evidence we prefer the evidence of Mrs Innes. We find that there was minor interference caused by BROOKBY. However, we find that the minor interference did not interfere with the chances of OH BUOY gaining a better placing. In considering this protest we take account of the ? length margin between third and fourth. Accordingly the protest is dismissed and the Judge's placings stand.
