Following the running of race 7 an information alleging a breach of rule 869 (3) (b) careless driving, the informant was Mr J M Muirhead and the defendant Mr A Grayling

Following the running of race 7 an information alleging a breach of rule 869 (3) (b) careless driving, the informant was Mr J M Muirhead and the defendant Mr A Grayling the driver of Tar Del . The information alleged that Mr Grayling drove Tar del carelessly causing interference to Eminem driven by Mr N Chalmers inside the last 100 meters of the race. Mr Grayling did not admit the breach and was present at the hearing. Mr Muirhead showed the video of the run home and this showed that Mr Grayling had angled Tar Del for a run wide on the track and had moved out and taken the legs of Eminem when under a drive.

Mr Muirhead called Mr Chalmers to give evidence and Mr Chalmers stated that Tar Del had made contact with his horse and had taken his legs and caused his horse to break from it's gait and lose all chance. Mr Grayling acknowledged to Mr Chalmers that Tar Del had struck Eminem and caused it to break and lose its chance.

Decision And Reasons.

Having taken into account the video evidence and also the evidence of Mr Murhead and Mr Chalmers I find that Mr Grayling is in breach of rule 869 (3) (b ) and drove carelessly in this race.

Mr Grayling by his own admission stated that his horse had struck the legs of Eminem and caused it to break. Mr Grayling angled for a run wide out, however under a drive Mr Graylings horse continued to progress outwards and made contact with Eminem causing it to break and lose it's chance.

Submissions were heard on penalty from both Mr Muirhead and Mr Grayling, Mr Grayling preferring a fine rather than a suspension. Mr Graylings driving record was produced for perusal and verified by him. A Fine of $275.00 was imposed in this instance.
