Following Race 1 an information was filed by the informant Mr N Waddell, pursuant to Rule 876 (1). He alleged that LUNUS, placed 3rd by the judge, interfered with the chances of ROMEO, placed 4th by the judge.

Following Race 1 an information was filed by the informant Mr N Waddell, pursuant to Rule 876 (1). He alleged that LUNUS, placed 3rd by the judge, interfered with the chances of ROMEO, placed 4th by the judge. The margin between 3rd and 4th was 1 1/2 lengths.
--Present at the enquiry were
--LUNUS - Jockey Ms L Cropp
--ROMEO - Jockey Mr M Sweeney
--Connections were advised of the protest and consented to be represented by their respective riders.
--Mr M Sweeney demonstrated the video films and showed where soon after entering the straight the gap ahead, which he was entitled to, closed slightly caused by inward movement from LUNUS (L Cropp) on his outside. Mr Sweeney said he had to take hold for 3 - 4 strides. He also stated he was further inconvenienced for 2 or 3 strides at the 300 metre mark.
--Ms Cropp said in her statement that STAND TALL had forced ROMEO out contributing to the closing of the gap. She said she came from behind Mr Sweeney and was well past when Mr Sweeney had to take a hold.
--Stipendiary Steward Mr Oatham when asked for his assessment, said that while Mr Sweeney did have his line taken, and had to take a hold momentarily, he believed that with the 1 1/2 length margin at the post the interference was not enough to change the placings.
--DECISION :
--The Committee considered all submissions and are satisfied that ROMEO (M Sweeney) did receive a check when the gap closed, soon after entering the home straight. However, it was also clear that LUNUS was not solely to blame for this as STAND TALL had moved out slightly as well, contributing to the gap closing slightly.
--Taking into account the 1 1/2 lengths at the post and the mitigating factors above, we are satisfied that the chances of ROMEO finishing in a better place were not affected. Accordingly the protest is dismissed and the judge's placings shall stand.
