An information lodged by Stipendiary Steward Mr J Muirhead against Mr M McKendry, driver of JAZZ BROMAC alleging a breach of Rule 869 (4) - (6) (b) and (c) - Push out, in that he moved his horse outwards from the running line with approximately 1700m to run and forced IN HOLLYWOOD, driven by Mr P Ferguson, to race wider on the track.
--Mr McKendry admitted the breach and was present at the hearing.
--Mr Muirhead demonstrated the incident by use of the video film. Mr McKendry moved his horse outwards and IN HOLLYWOOD which was improving on its outside was forced to race wider. Mr McKendry said that his horse had been racing a little bit greenly at the time.
--PENALTY
--Stipendiary Steward Mr Muirhead said Mr McKendry had a clear driving record as far as this type of breach was concerned and that it was not a serious breach of the Rule. He recommended a fine of $200.00. In fixing penalty I took into account the following matters :

- The guilty plea. --
- Mr McKendry's clear driving record. --
- The offending was not of a serious nature. --
- The submissions of Mr Muirhead. --
- The explanation of Mr McKendry, which raised a mitigating, factor.
Taking all of those matters into account I imposed a fine of $200.00.
