Ten minutes prior to the running of race 3, the Insulation Factory Intermediate Steeplechase, horse No 5, Ultimate Conquest was presented with shoes not approved for racing



Ten minutes prior to the running of race 3, the Insulation Factory Intermediate Steeplechase, horse No 5, Ultimate Conquest was presented with shoes not approved for racing and as a consequence was subsequently declared a late scratching by the Stipendiary Stewards.

Following the running of the race an information was against K Mitchell, as agent for trainer C Thornton, alleging a breach of rule 867 (3) ?

Miss Mitchell admitted the breach.

PENALTY

--

Stipendiary Steward Mr Oatham stated that there was a clear obligation to present the horse with correct plates. He also stated that the Foxton Racing Club had suffered financially because of the late scratching, and it was his submission that the matter be dealt with by way of a moderate fine.

Miss Mitchell, when addressing the committee, explained that the horse had been plated some 10 days previously and she had assumed that the trainer would have attended to the matter. No further check had been made on the horse's shoes and their suitability for racing.

Miss Mitchell made no submissions as to penalty.

--

The Judicial Committee after considering submissions from Miss K Mitchell and Stipendary Steward Mr J Oatham find that a fine of $300.00 is the appropriate penalty in this case. This being consistent with penalties imposed for similar breaches of this rule.
