At the Wellington Racing Club meeting on 6 December 2008 Information 015 was filed pursuant to Rule 1002(1)(b) alleging that M Wallace rode track work at the Otaki Racecourse on the morning of 26 November 2008 without a safety vest.

At the Wellington Racing Club meeting on 6 December 2008 Information 015 was filed pursuant to Rule 1002(1)(b) alleging that M Wallace rode track work at the Otaki Racecourse on the morning of 26 November 2008 without a safety vest.

Stipendiary Steward Mr Goodwin read the rule and Mr Wallace acknowledged that he both understood the rule and admitted the breach.

Mr Goodwin asked Stipendiary Steward Mr Neal to outline the facts that led to the information being filed. Mr Neal said that he was carrying out an inspection at the Otaki track on 26 November 2008 and that at approximately 9.00am he saw Mr Wallace coming off the track after riding work. He said he asked Mr Wallace if he had a safety vest on and Mr Wallace said that he did not.

In reply Mr Wallace said that earlier that morning he had worked horses at the Otaki beach and, because it was raining and his clothes were wet, before working other horses at the Otaki track he changed his clothes but forgot to put his safety vest on. He said that he normally wore his safety vest at all times but had on this occasion forgot to put his vest on because he was in a rush as he had to get his horses worked before the track closed.

DECISION/PENALTY:

Mr Goodwin advised that Mr Wallace had been previously charged under rule 304 in December 2005 and had been fined $300 and he submitted that a fine in the excess of $300 was appropriate for this case.

Whilst noting the previous charge on a related matter, it was 3 years ago. However, the Committee is mindful of the significant health and safety issues when any rider does not wear the required safety equipment and also of the regular reminders issued by Thoroughbred Racing to all trainers, jockeys and track work riders of the need to wear the required safety equipment at all times.

After reviewing the facts as presented by both parties we impose a fine of $400.
