Following race 6 an information was filed pursuant to Rule 871(3). The informant, Mr R Sanders, alleged that Mr P Boylan, rider of WILLIE WINIT made a celebratory gesture prior to the winning post.

Mr Boylan pleaded guilty to the charge.
Mr Sanders said Mr Boylan stood up in the saddle and made a celebratory gesture three strides before the post.
--Mr Boylan said he was excited to win a big race and thought he was past the post when waving his whip.
--PENALTY SUBMISSIONS:
Mr Sanders said this was Mr Boylan’s first charge under this rule in the last 12 months. He submitted a fine of $200 would be appropriate.
PENALTY:
The Committee considered all evidence and submissions and before imposing penalty took into account the following:
1. Mr Boylan’s record.
2. His guilty plea.
The Committee told Mr Boylan of his obligations, particularly the fact that in a close finish like this, a celebratory gesture can unbalance a horse putting his finishing place in jeopardy. Accordingly we impose a $200 fine.
