Following Race 7 an Information was filed pursuant to Rule 856(1), 858(1)(a) & 523(3) when it was alleged by the Informant Mr A Coles that Mr M Walker, rider of D?ARTAGNAN which finished 5th in the race failed to weigh-in.

DECISION AND REASON:
--Following Race 7 an Information was filed pursuant to Rule 856(1), 858(1)(a) & 523(3) when it was alleged by the Informant Mr A Coles that Mr M Walker, rider of D?ARTAGNAN which finished 5th in the race failed to weigh-in.
--Mr Walker pleaded guilty to the charge.
--In his submissions, Mr Walker said he came in the losers gate and did not realise he had finished fifth. He said he had already told the trainer, Mr Autridge, he would pay to the owner the fifth prize money.
--Mr Coles said it was Mr Walker's first charge under this rule since 2003, and Mr Walker had been fully co-operative and honest in the matter. He believed the penalty could be handled by way of a fine.
--Decision on Penalty:
--The Committee considered all submissions and took into account Mr Walker's guilty plea and honesty in the matter. However, it was pointed out to Mr Walker it was his obligation under the rule to determine where he had finished and as a result of his carelessness the owners lost a stake of $125. The horse D?ARTAGNAN is automatically disqualified and we further order Mr Walker's riding fee to be forfeited. Further we impose a fine of $275.
