An Information was lodged by Stipendiary Steward Mr C J Allison alleging that Mr G R Davis, trainer of JUSTACONA, scratched JUSTACONA at 4:15pm on the 16th of February 2007 without sufficient circumstances.

An Information was lodged by Stipendiary Steward Mr C J Allison alleging that Mr G R Davis, trainer of JUSTACONA, scratched JUSTACONA at 4:15pm on the 16th of February 2007 without sufficient circumstances.
--Mr Allison outlined the circumstances surrounding the late scratching, acknowledging that there were mitigating circumstances on Mr Davis' behalf.
--Mr Davis stated that he had been on jury duty on a major case (and was Foreman) over a long period of time, leading up to and on the raceday. He stated that due to the confidentiality of the court system he was not allowed to make any contact to the "outside world" from the time the jury retired to make its decision. This process proved far more lengthy than either he or the Court imagined, the jury deliberating for an afternoon, evening and then the following day, jurors overnighting in a city hotel.
--Mr Davis also stated his horse was unruly, difficult to drive and that he had no opportunity to organise a senior horseman to drive the horse. Mr Allison confirmed Mr Davis' comments regarding the horse's manners and being very difficult to drive. Mr Davis stated his actions were unavoidable in this instance.
--REASON
--In my opinion, clearly a breach of the Rule had occurred, and the charge was upheld. In fixing penalty, no fine was imposed, due to the extreme mitigating circumstances, which all parties acknowledged.
