Decision: Following race 2 an information was filed by Mr J P Oatham alleging that K Hercock committed a breach of Rule 871(1)(d) when she shifted inwards after the start
DECISION & REASON:
--Following race 2 an information was filed by Mr J P Oatham alleging that K Hercock committed a breach of Rule 871(1)(d) when she shifted inwards after the start on DANNY?S DAUGHTER when not sufficiently clear of LIBERTY (D Hain) who clipped a heel and stumbled. Miss Hercock admitted the offence.

Mr G Stewart demonstrated the video which clearly showed Miss Hercock, soon after the start, rapidly crossing towards the running rail, and in doing so taking the line of LIBERTY who clipped heels and nearly fell.

Because of Miss Hercock's admission of the offence we are only required to consider a penalty.

Mr Oatham, in his submissions, mentioned Miss Hercock's good record and her admission of guilt, but asked for a suspension.

Miss Hercock had nothing to say.
----
In taking into account Miss Hercock's record and admission of the breach the Committee also take into account the severity of the offence, which they consider to be of a serious nature which could have had more serious consequences. We therefore suspend her from riding from the conclusion of racing on 15 November until the conclusion of racing on 22 November.
